Ultimately, the success we’re going to have with a case depends upon the preparation. If we prepare cases to go to trial, then whether the case goes to trial or gets settled short of trial, we maximize what we’re going to be doing for the client.
We can’t prepare enough. Prepare, prepare, prepare. There really is no substitute for visualizing every single case and what it will look like before the jury.
A trial has often been compared to an iceberg. What you see in court is just the tip of what people do here every day getting the case ready. It’s the privilege of the lawyer to be the person who is in court but what goes into that is really an enormous undertaking.
We rely on the best experts that we can possibly find. We’ve developed a vast network of experts that we can rely upon in any particular field; doctors, engineers, accident reconstruction people, etc. We use economists to evaluate destruction of learning capacity, we use rehabilitation specialist for people who have suffered life altering injuries and in medical negligence cases, we need to have doctors or nurses involved to help us understand the medicine.
We are not going to cut corners financially. If we need to spend money, whether to get the right expert or to get two experts or to just do whatever is necessary to prepare the case for trial as best as we can, we do it.
Lots of times personal injury cases are very difficult and they have complicated issues, especially in the medical malpractice field. Those things need to be talked about as a group and we are always bouncing ideas and legal concepts and factual situations around with each other.
